PROPOSED LOCAL LAW NO. 2 OF 2015 AMENDING CHAPTER 57, OF THE CODE OF THE INCORPORATED VILLAGE OF HUNTINGTON BAY AS IT RELATES TO THE HOURS OF OPERATION OF COMMERCIAL LANDSCAPING SERVICES IN THE VILLAGE

 

Be it enacted by the Board of Trustees of the Incorporated Village of Huntington Bay as follows:

 

Section 1. Amendment.

 

Chapter 57 of the Code of the Village of Huntington Bay shall be amended to read as follows:

§ 53-7. Prohibited noises.

 

D.  Unnecessary noises enumerated.  The following acts, among others, are declared to be loud,

disturbing and unnecessary noises in violation of this chapter, but said enumeration shall not be deemed to be exclusive, namely:

(11)   The operation of any commercial landscaping services between the hours of 5 p.m.

and 8 a.m. on Monday through Friday, and before 8 a.m. or after 4 p.m. on Saturday and all day Sunday, except in the case of an emergency or in the interest of public health and safety and then only with the permission of the Mayor or the Police Commissioner or the Chief of Police.

Section 2. Severability.

 

If any clause, sentence, paragraph, section, or part of this local law shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder hereof, but shall be confined in its operation to the clause, sentence, paragraph, section or part hereof directly involved in the controversy in which judgment should have been rendered.

Section 3. Effective date.

 

This local law shall take effect immediately upon filing with the New York Secretary of State.
