VILLAGE OF HUNTINGTON BAY

PUBLIC NOTICE

2015-2016 BUDGET HEARING

PLEASE TAKE NOTICE that a public hearing will be held by the Board of Trustees of the Inc. Village of Huntington Bay on Monday, April 27, 2015 at 7:30 p.m. at the Huntington Yacht Club, 95 East Shore Road, Huntington Bay in said Village regarding the adoption of a Local Law 1-2015 of the Incorporated Village of Huntington Bay entitled "Salaries and Compensation” creating a new chapter of the Code of the Village of Huntington Bay.

PROPOSED LOCAL LAW NO. 1 OF 2015 CREATING A NEW CHAPTER OF THE CODE OF THE VILLAGE OF HUNTINGTON BAY ENTITLED “SALARIES AND COMPENSATION”

Be it hereby enacted by the Board of Trustees of the Incorporated Village of Huntington Bay as follows:

Section 1.        Purpose.

The purpose of this chapter is to promote the public health, safety and welfare of the Village of Huntington Bay, including the protection and preservation of the property of the village and its inhabitants, by establishment of a procedure whereby the efficient and prudent administration of the municipal affairs is promoted through the establishment and fixing of annual compensation for elected officials of the Village of Huntington Bay.

Section 2.        Findings.

It is the finding of the Board of Trustees of the Village of Huntington Bay that the executive, legislative, policy and fiduciary responsibilities associated with the positions of mayor and trustee have increased significantly over the past several years as the operations of the Village of Huntington Bay have become more complex.  In order to fulfill their duties, the Mayor and the members of the Board of Trustees find that they each must now dedicate a greater amount of time on a daily basis to a variety of matters that are necessary for the Village to function properly and efficiently.  Accordingly, the Board of Trustees finds that it is in the best interests of the Village and its residents that persons serving in the positions of mayor and trustee shall be entitled to annual compensation in the amounts set forth herein.

Section 3.        Compensation for elected officials.

A.Compensation Amounts.  The annual compensation for the following elected officials shall be fixed at the following sums to be paid in equal monthly installments during his or her term of office:

Mayor:                                              $18,000

Trustee-Police Commissioner:      $4,800

Trustee-Road Commissioner:        $4,800

Trustee:                                            $2,400

B. Limitations.

The annual compensation amounts set forth above shall be the maximum amounts paid to an elected official.

A Trustee may not simultaneously serve as both the Police Commissioner and the Road Commissioner, and the Mayor may not serve as either the Police Commissioner or the Road Commissioner.

C. Restriction on Benefits.

Elected officials shall not receive any other compensation or employee benefits from the Village other than those that are mandated by law.

Section 4.        Permissive referendum.

The adoption of this local law is subject to a permissive referendum pursuant to Article 9 of the Village Law.

Section 5.        Severability.

If any section or provision of this local law shall be adjudged to be invalid by any Court of competent jurisdiction, such judgment shall not affect, impair or invalidate any other part of this local law or the remainder thereof, but shall be confined in its operation to the section or provision or part thereof directly involved in the controversy in which such judgment shall have been rendered.

Section 6.        Effective date.

This local law shall take effect upon the completion of the procedural requirements for local laws subject to permissive referendum and the subsequent filing thereof with the Secretary of State, but in no event shall said law become effective prior to June 1, 2015.

Any interested person is entitled to be heard upon said proposed Local Law at such public hearing.  Copies of said proposed Local Law are available for review at the Incorporated Village of Huntington Bay Clerk's Office at Village Hall, Monday through Friday from 9:00am until 3:00pm.

By order of the Board of Trustees of the Incorporated Village of Huntington Bay,

dated April 20, 2015.

Gail Devol, Village Administrator
