STORMWATER MANAGEMENT NOTICE

Local Law No.1 of the Year 2011

A local law entitled, “Chapter 19 Waterfowl and Goose Feeding”

Be it enacted by the Board of Trustees of the Incorporated Village of Huntington Bay as follows:

The Code of the Village of Huntington Bay is hereby amended to add a new Chapter 19, which was previously reserved, to read as follows:

 

CHAPTER 19
WATERFOWL AND GOOSE FEEDING

 

Section 19-1. Findings of Fact.

The Board of Trustees of the Village of Huntington Bay has determined that artificial feeding of geese and waterfowl contributes to high concentrations of geese, waterfowl and seagulls at unnatural sites, overcrowding, the spread of disease, costly management efforts, unnatural behavior, and cumulative negative environmental impacts on the water bodies in Huntington Bay and Huntington Harbor.

Section19-2. Definitions.

Unless otherwise expressly stated in this chapter, the following terms shall have the following meanings:

GEESE – Those species of birds commonly known as “Canada geese.”

WATERFOWL – Those species belonging to the order Anseriformes, including but not limited to swans, Mallards and all species of ducks.

SEAGULLS – Those species of birds belonging to the order Laridae.

FEED – To give, place expose, deposit, distribute, or scatter any edible material with the intention of feeding, attracting or enticing geese, waterfowl and/or seagulls.

PERSON – Any individual, company, partnership, corporation, limited partnership, joint venture or other legal entity.

 

Section 19-3. Prohibited Acts.

No person shall feed or provide food for any geese, waterfowl and seagulls within the Incorporated Village of Huntington Bay at any time of the year.

Section 19-4.  Penalties for Offenses.

A violation of this chapter shall be punishable by a fine of $250.00

 Section 19-5.  Severability.

If any part or provision of this Chapter or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Chapter or the application thereof to other persons or circumstances, and the Board of Trustees of the Incorporated Village of Huntington Bay hereby declares that it would have passed this Chapter or the remainder thereof had such invalid application or invalid provision been apparent.

Effective Date.

            This Local Law shall take effect immediately upon filing in the Office of the Secretary of State of New York.
