Zoning Board of Appeals- March 17, 2011

Mr. Cavanagh called the meeting to order at 7:30 p.m.  He stated that there were two (2) public hearings on the agenda.

Mr. Williamson read the criteria by which the Zoning Board of Appeals makes its determination.

Public Hearings:

Dr. Maria Sherry, Crescent Beach Drive
Robert Flynn, Jr., an attorney, representing Dr. Sherry presented an overview of the application to construct a single family dwelling on an undeveloped parcel. He then called on John Reilly, an architect, to explain the application. Dr. Sherry testified in favor of the application, John Breslin, real estate expert, was called to testify as was Christopher Robinson of RMS Engineering and Roy Haje of EN Consultants.  Kenneth Savin, an attorney, representing neighbors Mr. Novick and Mr. Mackey testified in opposition to the application and called on Norman Gerber, a planner to offer testimony.  Many neighbors voiced their concerns about the placement of the driveway.  The hearing remains open but was adjourned at 9:15pm.  A transcript was taken by Laura Pinto.

James Murphy, an attorney, presented an overview of the application to construct a single family dwelling on an undeveloped parcel.  Alex Latham, and architect, began to describe the application.  It became evident that a height variance would also be necessary.  The request for relief from Village Code § 91-11.B.(1)(a) had not been sought nor was it part of the public notice; at which time the hearing was stopped.  The application will be corrected and the required notice placed for a hearing next month. The hearing was adjourned at 10:00pm.  A transcript was taken by Laura Pinto. 

A motion made by John Woodward to approve the February minutes was seconded by John Williamson and approved 3/0.  Mr. Antonucci abstained as he did not attend the February meeting. 

With no further business to be brought before the Board, Mr. Cavanagh closed the meeting at 10:25p.m.
