Minutes, Board of Trustees March 21, 2005

Mayor Morrow opened the meeting at 7:30p.m.

Police Chief’s Report:
The Police Department received training in the “Use of Force”. Officer Jack was trained on radar. Further training for the department will continue this month. A DWI traffic stop was set up more will be done later in the Spring. There was an arrest for aggravated unlicensed and grand larceny for stolen credit cards this past month. Mayor Morrow asked that the Chief keep in close contact with the Second Precinct so the department is aware of what is going on in the Town, especially regarding gang activity.

Public Hearing – Lawler – 290 Bay Avenue – Addition & Alteration
At 7:45p.m. Kevin Lawler came before the Board for relief from the building moratorium, which is in effect until June 15th. Mr. Lawler showed pictures of his leaking roof which is causing mold and water damage. A motion was made by Mr. McCusker to approve the Lawler application, seconded by Mr. Rave and unanimously approved. The transcript for this hearing was taken by Laura Pinto.

Public Hearing – Vitiello – 32 Bay Crest – Addition

At 8:10 p.m. Neal Hoffman, R.A. came before the Board with a proposed addition for a recreation room off the garage as well as a mudroom. This application is before the Board because the property is in the Waterfront Preservation District. This application was presented before the Zoning Board last year and therefore is not affected by the moratorium. A motion was made by Mr. Gai to approve this application, seconded by Mr. Rave and unanimously approved. This hearing was closed and the transcript was taken by Laura Pinto.

Public Hearing – Armonas – Beach Road – New House
At 8:35 Alex Armonas came before the Board with a tree removal plan, landscape plan, the difference between this plan and the approved Sansivero plan and analysis of the design and covenant to maintain the Hemlock hedge. The Board and several neighbors agreed that the house was too big for the lot. Mayor Morrow suggested that there be an Issues Conference. At 9:10p.m., the discussion concluded. Code Revisions
The Board discussed floor area ratios, and lot area coverage percentages for the different zoning districts. Mr. Gesualdi will draft local law regarding architectural review will be on for next month.

Local Law 2-2005 – Amendment to Village Code Regarding Floor Area Ratio
Mr. Gesualdi presented the proposed local law and discussed it with the Board. A motion was made by Mr. McCusker to approve Local Law #2-2005, seconded by Mr. Meyer and unanimously approved.
A motion was made Mr. McCusker to approve a Negative Declaration for the F.A.R. and L.A.C., seconded by Mr. Gai and unanimously approved.

Local Law 3-2005 – Amendment to Village Code Regarding Accessory Apartments
Mr. Gesualdi presented the proposed local law and discussed it with the Board. A motion was made by Mr. McCusker to approve Local Law 3-2005, seconded by Mr. Meyer and unanimously approved.

Village Attorney’s Report
The Mayor will review a proposal from the Town for Waterfront enforcement. There was a discussion about some sheds that were built without a permit. Mr. Kinch will issue them a notice that the sheds either have to be repaired or removed.

Village Administrator
The budget will be distributed next week. April 5th is the first day independent nominating petitions can be signed.

Financials / Bills
The Board reviewed the interim financial statements and the list of bills and after careful review, questions and discussion, a motion was made by Mr. Gai to approve the list of bills and the interim financial statements, seconded by Mr. Rave and unanimously approved.

Road Commissioner’s Report
Mr. Gai will present a report next month regarding property that was damaged by plowing and whether or not it is the Village’s contractors fault or the fault of private contractors.

With no further business to be brought before the Board, the monthly meeting was closed at 10:45p.m.
