Zoning Board of Appeals June 21, 2007

Mr. Prior called the meeting to order at 7:30 p.m.  He stated that there were four applications on the agenda this evening.


Mr. Cavanaugh read the criteria by which the ZBA makes their decisions.  Ms. Manin added that in most cases the ZBA will render their decision at the next meeting but in all cases, the decision will be rendered within 62 days and mailed to the applicant by the Village Administrator.

Public Hearing: Glen & Ann Klages, 31 Taylor Road.  Mr. Prior read the public notice.  Lee Reynolds, attorney for the applicant, presented the application to legalize an existing deck which was built without a permit.  The hearing was closed at 7:50pm. A transcript was taken by Laura Pinto. 

Public Hearing: Jay Garfinkel, 31 Upper Drive.  Mr. Prior read the public notice.  Andrew Schmitz, architect for the applicant, presented the application to add a new master bedroom over an existing one story section of the dwelling, to legalize and existing shed and brick bar-b-que.   The hearing was closed at 8:05 pm.  A transcript was taken by Laura Pinto.

Public Hearing:  Fran Geier, 23 Heckscher Drive.  Mr. Prior read the public notice. 
Andrew Schmitz, architect for the applicant, presented the application for additions and alterations to an existing dwelling to increase the square footage of the dwelling from 2950 sq. ft. to 4273 sq. ft. including the garage.  The applicant also wishes to construct an outside stairway for access to the basement.  Neighbors expressed their concerns. Mr. Schmitz requested that the hearing remain open in order to consult with his clients and submit a revised application.  The hearing concluded at 9:20pm.  A transcript was taken by Laura Pinto.

Public Hearing:  Frank Perruzza, 21 Bay Road.  Mr. Prior read the public notice.  Mr.  Perruzza came before the board to present his application to legalize an addition started without a permit and is the subject of a current Stop Work Order, and to legalize retaining walls built without a permit.  This hearing was postponed until Mr. Perruzza fulfills the terms of the ZBA decision rendered in 2000. No testimony was taken.  A transcript was taken by Laura Pinto.

 Decisions
A motion, made by Mr. Cavanagh to approve the Herbert decision was seconded by Mr. Williamson and approved 3/0.

Minutes
A motion made by Mr. Woodward to approve the May 17th minutes, was seconded by Mr. Cavanagh and approved 3/0.  

A motion made by Mr. Cavanagh to approve the May 29th minutes was seconded by Mr Williamson and approved 3/0.

At 10:00 pm the board entered into executive session to discuss pending litigation.  At 10:05pm the board reconvened in open session. 

The board discussed the applications presented.

With no further business to be brought before the Board, Mr. Prior closed the meeting at 10:30p.m.
