Mayor Morrow opened the meeting at 5:00p.m. There
is one public hearing this evening.
Public Hearing – McCormack –
290 Vineyard Road
Mr. Kinch explained the application was to seek relief
from Village Code Chapter 91, Article III, Section
91-10. A. (5) and Chapter 13, Article III, Section
13-10 regarding vision clearance in order to allow
one tree to remain within thirty feet of the McCormack
property boundary on a corner lot. Mrs. McCormack
stated that she believed the tree was not a visual
obstruction. A motion made by Mr. Gai to approve the
application was seconded by Mr. Meyer and unanimously
approved. The hearing was closed at 5:15pm. The transcript
for this hearing was taken by Laura Pinto.
Mr. Gai made a motion to waive the filing fee for
Mrs. McCormack’s application. The motion was
seconded by Mr. McCusker and unanimously approved.
Amendment to Village Budget
Mayor Morrow explained that there was a software generated
typographical error discovered in calculating the
revenues for the 2004-2005 Village Budget. Mayor Morrow
and Village Administrator Lynn Pincomb revised the
expense portion of the 2004-2005 budget and a resolution
was prepared amending the budget. The motion made
by Mr. McCusker to adopt the attached resolution amending
the budget was seconded by Mr. Meyer and unanimously
approved.
Mrs. Ginger Dara, 4 Locust Lane, asked to address
the board regarding the lights on the tennis court
at 251 Huntington Bay Road. She said the lights, which
are not shielded, have been turned on even though
a Certificate of Compliance has not been issued. Mrs.
Dara suggested that the tennis court was constructed
at too high an elevation and the addition of very
tall pole lighting makes it almost impossible to shield
her property from the lights. Mr. Jones, 47 Bay Road,
agreed and added that all the trees that might have
provided shielding had been taken down. Mr. Kinch
has written to the McGuigans and enclosed a copy of
LL4-2004 on Lighting and informed them that the lights
must be brought into compliance. Mr. Gai suggested
that the neighbors put their concerns in writing to
the Village. Mrs. Dara and Mr. Jones left the meeting
at 5:45pm.
Proposed Plan to Dump Dredging Soils
The Town of Huntington and the four Villages want
to retain outside counsel to comment in opposition
to the EPA plan and to commence litigation if needed.
The Town Board, Lloyd Harbor, Northport and Asharoken
have approved a resolution retaining the firm of Tomey,
Lathan, Shea & Kelley, LLP. There is a cap of
$5,000 on fees for this matter with 50% being paid
by the Town and the other 50% being shared by the
four Villages. Mr. Gai moved that Huntington Bay join
the Town and the other three villages in this important
environmental effort. The motion was seconded by Mr.
Meyer and unanimously approved.
Village Attorney’s Report:
Mr. Gesualdi reviewed and discussed his report with
the Board.
Village Administrator’s Report
Mrs. Pincomb presented her report.
Financials / Bills
The Board reviewed the interim financial statements
and the list of bills and after careful review, questions
and discussion, a motion was made by Mr. McCusker
to approve the list of bills and the interim financial
statements, seconded by Mrs. Prior and unanimously
approved.
At 6:10pm the Board convened in Executive Session
to discuss police contract negotiations. The Board
reconvened in regular session at 6:45pm. Mr. McCusker
moved to forego appeal on the recent perb decision.
Seconded by Mrs. Prior and unanimously approved.
With no further business to be brought before the
Board, the monthly meeting was closed at 6:55p.m.
