Minutes Board of Trustees July 11, 2011

Mayor Morrow opened the meeting at 7:40 pm.  There is one (1) Public Hearing this evening.

Mayor Morrow swore in newly reelected Trustee Dennis Gai.

Mayor Morrow presented for approval the Village appointments for FY 2011-2012.
Don Rave moved that the appointments be approved as presented, seconded by Dennis Gai and approved 3/0.

Chief’s Report
Chief Hubbs delivered his report to the Board.  There were no major problems over the July 4th weekend.  In response to a complaint of speeding on Bay Rd. the patrols have been stepped up and the stop sign is being monitored more closely.  Chief Hubbs wrote to Legislator Cooper requesting a legislative grant for the purchase of tasers.  Neither the County nor State bid for new police cars have been finalized.  The Chief and Mayor met with representatives of the associations.   

Public Hearing:

Michael & Mary Haegerty, 317 Vineyard Road
The property is located in the Waterfront Preservation District ‘C1.’ Jim Morgan of Ireland Gagnon Associates presented the application to construct additions and alterations to an existing dwelling and garage.  Ms. Manin presented a background of the application and stated that the ZBA had approved the variances requested.  Mr. Vollmuth stated that the at least ½ of Willow Pond is located on this site and that the outflow for the pond was located on the property.  It was acknowledged that it is the property owner’s responsibility to maintain the outflow. The following are conditions of approval: a DEC Tidal and Fresh Water Wetland permit is required, SCHD approval for the garage septic and a revised site plan approved by the Village Engineer.

Subject to the above, a motion to approve the application was made by Dennis Gai, seconded by Don Rave and approved 3/0.  The hearing concluded at 8:30 pm.  A transcript was taken by Laura Pinto.

Public Comment
Roger Fay appeared before the Board to request assistance in appealing to the Town of Huntington about the flooding in Bay Hills due to run off from the town.  

Ms. Suzanne DeLisi appeared before the Board to ask about her requests presented last month.  Mr. Gai reiterated the Village’s position that Bay Crest Roads are privately maintained roads with public assess.    

The Board reviewed correspondence from Howard Novick, 102 Crescent Beach Drive, regarding Dr. Sherry’s application to construct a new dwelling on Crescent Beach Drive.  Application for Site plan review has not yet been submitted.  

Attorney’s Report
Mara Manin presented her report. 

Stormwater Management Report
Village Engineer Jeff Vollmuth presented the report to the board.  We have had no public comments.  Brochures are available at Village Hall and information and links are posted on the Village web site.  The report will be delivered to the DEC by the due date of July 15th.  A transcript was taken by Laura Pinto.

Administrator’s Report
Lynn Pincomb presented her report. 640 Tax payments have been received. Delinquent letters were sent out on July 6th. One additional snow assessment remains unpaid. Hulse & Co. is continuing the preparation of the YE financial statement.

Financials/Bills
The Board reviewed the interim financial statements from June and the list of bills. After review, questions and discussion, a motion was made by Don Rave to approve the list of bills and the interim financial statements for June which was seconded by Dennis Gai and approved 3/0.

Minutes
A motion made by Don Rave to approve the June minutes as corrected was seconded by Dennis Gai, and approved 3/0.   

The Board entered into Executive session at 10:10p.m. to discuss potential litigation and reconvened in open session at 10:30.

At 10:40 pm, with no further business to be brought before the Board the meeting was closed.
