Zoning Board of Appeals July 19, 2007

Mr. Prior called the meeting to order at 7:30 p.m.  He stated that there were 4 applications on the agenda this evening.


Ms. Manin read the criteria by which the Zoning Board of Appeals makes its determination.

Public Hearing:

John Kalas, 255 Huntington Bay Road.  Mr. Prior read the public notice.  Mr. Kalas presented the application to construct a pool and patio.   
Mr. Kalas read a letter into the record whereas his neighbor, Mr. Bilzi did not have an objection to the driveway encroachment the application for a variance.  Ms. Manin suggested the applicant consider a boundary line agreement with the adjacent neighbor.    A transcript was taken by Laura Pinto.  Hearing Closed at 7:45 p.m.

Fran Geier, 23 Heckscher Drive.  Mr. Prior read the public notice.  Mr. Schmitz, Architect for the applicant, presented the revised application to construct additions and alterations.  Revisions included: reduced patio size, trees planted along both sides of home, redesigned driveway to conform to setbacks, and reduced overall size of the house. Neighbors still expressed concerns. A transcript was taken by Laura Pinto. The hearing closed at 8:40 p.m.

Gary and Diane DeLuca, 291 Vineyard Road.  Mr. Prior read the public notice.  George Dirr, Architect for the applicants presented the application to construct additions and alterations. The applicant is looking to add a front screened in porch and make the lower level of the house a fully accessible habitable space.  Mr. Kinch was asked by the board to determine if the house was two stories or three stories.  He will report his findings to the board at the next meeting.  A transcript was taken by Laura Pinto.  The hearing closed at 9:15 p.m.

Leonard and Vicki Moskowitz, 12 Hillside Court.   Mr. Prior read the public notice.  Mr. Moskowitz presented the application to obtain a building permit to legalize and existing dwelling with a Certificate of Occupancy.  The applicant is selling the house.  The patio was in existence when the home was purchased and a retaining wall was created three years ago.  A transcript was taken by Laura Pinto.  The hearing closed at 9:30 p.m.

Decisions:

Jay Garfinkle, 31 Upper Drive. Application approved 3/0.  Mr. Williamson abstained as he was not present during the meeting.

Glen and Ann Klages, 31 Taylor Road.  Application approved 3/0.  Mr. Williamson abstained as he was not present during the meeting.

The board decided to meet on August 13, 2007 at 7:30 p.m.to render decisions on the cases that were heard this evening.

John Woodward made a motion to approve the minutes from June 21, 2007, which was seconded by Jay Cavanagh and unanimously approved.

With no further business to be brought before the Board, Mr. Prior closed the meeting at 10:25 p.m.
