Mr. Cavanagh called the meeting to order at 7:30p.m. He stated that there were two public hearings on the agenda this evening.
Mr.Williamson read the criteria by which the Zoning Board of Appeals makes its determination.
Public Hearings:
Marc & Nancy Arner, 19 Locust Lane Neal Hoffman, architect for the applicant, presented the application to legalize a portion of a swimming pool patio and entry piers, to enlarge a driveway and pool patio and to construct a pool cabana. The hearing was closed at 7:50 p.m. A transcript was taken by Laura Pinto
John and Kelly Ann Paci, 11 Beach Road
This hearing is continued from November 19, 2009. Michael McCarthy, an attorney and John Breslin, an attorney and real estate expert, presented the revised application to construct walks, a hot tub, a partial above ground pool, a cabana, seawall repair, a sports court, to legalize a bluestone patio under construction without a building permit and the subject of a Notice of Violation/Stop Work Order and to legalize a driveway extension built without a building permit. The hearing was closed at 9:10p.m. A transcript was taken by Laura Pinto.
Decisions:
A motion to approve the Raia decision was made by John Woodward seconded by John Williamson and approved 3/0. Mr. Antonucci was not at the December hearing and did not vote.
Pursuant to Village Law §7-712 a-12. A motion was made by John Williamson and seconded by Anthony Antonucci to rehear the matter of the Krach application previously heard on November 19, 2009. The motion was unanimously approved. The matter will be scheduled for a February hearing.
A motion to approve the December minutes was made by John Woodward, seconded by John Williamson and approved 3/0. Mr. Antonucci did not attend the December meeting and therefore did not vote.
With no further business to be brought before the Board, Mr. Cavanagh closed the meeting at 10:00p.m.
