Minutes Board of Trustees- August 15, 2011

Mayor Morrow opened the meeting at 7:40 pm.  He announced that due to health issues, John McCusker will leave the Board.  Mayor Morrow praised his contributions to the Board.   In September a replacement will be appointed to fill out the remainder of the year through June 2012.  That position will then be on the ballot for a one year term.

Chief’s Report
Chief Hubbs delivered his report to the Board. Last month Chief Hubbs wrote to Legislator Cooper requesting a legislative grant. Mr. Cooper responded that all money has been allocated for this year.  Neither the County nor State bid for new police cars have been finalized.  Ms. Delisi interjected that a stone pillar on Mr. Paar’s property was overturned. 

Public Hearing:

30 Bay Crest LLC, 30 Bay Crest  
The property is located in the Waterfront Preservation District ‘C1.’ Andrew Schmitz, an architect, presented the application to construct additions and alterations to an existing dwelling and garage. 

A motion to approve the application was made by Don Rave, seconded by Dennis Gai and approved 3/0.  The hearing concluded at 8:00 pm.  A transcript was taken by Laura Pinto. 

Albert Kemperle, 7 Heckscher Drive
The property is located in the Waterfront Preservation District ‘D1.’  Mr. Kemperle presented his application to construct an in ground pool, additional patios, to remove, reconstruct and enlarge an existing one story addition.  A new site plan showing drainage satisfactory to the Village Engineer must be submitted. 

A motion to approve the application was made by Dennis Gai, seconded by Don Rave and approved 3/0.  The hearing concluded at 8:15 pm.  A transcript was taken by Laura Pinto. 

Rudolph, 299 Bay Avenue
The property is located in Zoning District ‘D.”  Neal Hoffman, an architect, presented the application to construct additions and alterations to an existing dwelling.  A motion to approve the application was made by Don Rave, seconded by Dennis Gai and approved 3/0.  The hearing concluded at 8:20 pm.  A transcript was taken by Laura Pinto. 

A preliminary meeting was held to discuss the proposed Paternoster Plat.  Ms. Manin stated that now that the NYS Office of Historic Preservation has found no adverse impact would be created by the plan. A preliminary sub-division hearing can now be scheduled.  

Public Comment
Ms. Suzanne DeLisi requested the June minutes be amended to change the name Bay Crest Beach Association to Bay Crest Association.  The minutes will be so amended.

Ms. DeLisi requested that the Board act on her request previously presented to the Board. Ms. Manin responded that Ms. DeLisi was given an answer, Ms. DeLisi has commenced litigation and the matter would be discussed at the Court hearing.

Mr. Albert Hulse of Hulse & Co. CPA presented the report of the FYE audit. 

Attorney’s Report
Mara Manin presented her report.

Administrator’s Report
Lynn Pincomb presented her report.  As of July 31st 11 property taxes remain unpaid.   Delinquent letters were sent out on Aug. 1st.  All snow assessments have been paid.

Financials/Bills
The Board reviewed the interim financial statements from July and the list of bills. After review, questions and discussion, a motion was made by Don Rave to approve the list of bills and the interim financial statements for July which was seconded by Dennis Gai and approved 3/0.

Minutes
and approved 3/0.   

The Board entered into Executive session at 9:35p.m. to discuss potential litigation and reconvened in open session at 9:45p.m.

At 9:50 pm, with no further business to be brought before the Board the meeting was closed.
