Minutes, Zoning Board of Appeals, April 22, 2004

Mr. Prior called the meeting to order at 7:30 p.m. and stated that there are three public hearings this evening.

Public Hearing – Bunone - 156 Bay Road
Mr. Prior read the public notice. Mr. & Mrs. Bunone presented their application for a two story addition to their residence in order to accommodate their growing family. Mrs. Bunone explained that the addition would fully conform to the Code. Mr. Stokkers, who lives next door, called to express his support of the application. The hearing was closed at 7:40pm. A transcript was taken by Kelly Cruz.

Public Hearing – Pacifico – 289 Huntington Bay Road
Mr. Prior read the public notice. Mr. Pacifico presented his application to construct a detached pool cabana and a family room addition to his residence. Mr. Pacifico explained that all structures would fully conform to the Code. He also stated that the cupola shown on top of the cabana would not be built. He further informed the board that he has spoken with Mr. Guido, president of Fleetwood Acres Road Association, about improving the portion of Huntington Bay Road in front of his property. Mr. Eth of 5 Fleetwood Drive expressed concern about construction noise. Mr. Pacifico will obtain a copy of LL 3-2004 “Amendment to Village Code Regarding Weekend Construction Activities” and will duly inform his contractors of the regulations. The hearing was closed at 8:00pm. A transcript was taken by Kelly Cruz.

Public Hearing – Forbes – 19 Harbor Hill Road
Neither Mrs. Forbes nor her representative was in attendance, the hearing on this application was not opened.

Mr. Korn, architect for Mrs. Forbes, arrived at 8:15 after the close of the public hearing portion of the meeting and following the departure of the stenographer. Mr. Korn stated he thought the meeting began at 8pm. The application will be re-scheduled for a May hearing.


Decisions
After due deliberation, the board approved the Bunone and Pacifico applications.

Pereca – The board reviewed the decision and voted to approve the decision as presented which granted the relief relating to the proposed addition with the condition that the encroaching boat storage area, which also requires a Planning Board Steep Slope Special Permit, be removed, regraded and restored.

Mr. Rave was present and asked to address the board. Mr. Gesualdi pointed out that the hearing was closed and no further testimony could be heard. Mr. Rave proceeded to make a statement concerning his application.

At 8:25pm the board entered into executive session for the purpose of discussing privileged and confidential information with regard to the Rave application including but not limited to the prospect of threatened litigation.

The board closed the executive session at 8:55pm.

Mr. Gesualdi stated that the board had engaged in privileged and confidential communication regarding the Rave application and the prospect of the threatened litigation and requested he revise the draft decision.

Minutes
The Board reviewed the March minutes. A motion was made by Mr. Heimerich to approve the March minutes, seconded by Mr. Glackin and unanimously approved.

The next Zoning Board meeting will be held on May 20. With no further business to be brought before the Board, Mr. Prior closed the meeting at 9:00p.m.
