Local Law No. 3 of the Year 2006
A local law entitled, “Amendment
to Village Code Regarding Maximum Building Elevation.”
Be it enacted by the Board of Trustees
of the Incorporated Village of Huntington Bay as follows:
The Code of the Village of Huntington
Bay is hereby amended to revise Chapter 91 to read
as follows:

ARTICLE I
Purpose and Definitions

B. Definitions of terms. Unless otherwise expressly
stated, the following words shall, for the purpose
of this chapter, have the meanings herein indicated:

HEIGHT – The height of a building shall be
measured from the mean level of the ground surrounding
the building, at its existing natural grade and
not at its finished grade, to the top of the ridge,
provided that chimneys, and similar projections
shall not be included in the “height”.

§ 91-11. Dwellings. [Added 3-3-1951;

B. Limitation.
(1) Height.
(a) In a residence district, dwellings shall
not hereafter be erected of a height of more than
2 ½ stories or 35 feet.
(b) In the Waterfront Preservation District,
dwellings shall not hereafter be erected of a
height of more than 2 ½ stories or 30 feet.

Severability.
If any part or provision of this Local Law or the
application thereof to any person or circumstance
be adjudged invalid by any court of competent jurisdiction,
such judgment shall be confined in its operation to
the part or provision or application directly involved
in the controversy in which such judgment shall have
been rendered and shall not affect or impair the validity
of the remainder of this Local Law or the application
thereof to other persons or circumstances, and the
Board of Trustees of the Incorporated Village of Huntington
Bay hereby declares that it would have passed this
Local Law or the remainder thereof had such invalid
application or invalid provision been apparent.
Effective Date.
This Local Law shall take effect immediately upon
filing in the Office of the Secretary of State of
New York.
