INCORPORATED VILLAGE OF HUNTINGTON BAY
Local Law No. 3 of the Year 2009
A local law entitled, "Amendment to
Village Code Regarding Definitions of "Structure"
Be it enacted by the Board of Trustees
of the Incorporated Village of Huntington Bay:
The Code of the Village of Huntington Bay is hereby
amended to revise Chapter 91 to read as follows:

B. Definition of terms.

STRUCTURE – Any object constructed,
installed or placed on, above or below a parcel of
land for use, occupancy or ornamentation, including
but not limited to buildings, sheds, decks, dwellings,
mobile homes, trailers (whether movable or stationary),
stadiums, tents, reviewing stands, communication towers
and antennae, wind generators, solar heating devices,
tennis courts, platforms, porches, staging, observation
towers, gasoline pumps, standpipes, outside bins,
pools, docks, walls, retaining walls greater than
two (2) feet in height, bulkheading, fences greater
than six (6) feet in height, trellises, pergolas,
gates, gateposts, poles, signs, gazebos, pillars,
cabanas/pool houses, hot tubs, outdoor fireplaces,
non-portable barbecues, tanks and any fixtures, additions
and alterations thereto. The word “structure”
shall be construed as though followed by the word
“or part thereof.”

Severability.
If any part or provision of this Local
Law or the application thereof to any person or circumstance
be adjudged invalid by any court of competent jurisdiction,
such judgment shall be confined in its operation to
the part or provision or application directly involved
in the controversy in which such judgment shall have
been rendered and shall not affect or impair the validity
of the remainder of this Local Law or the application
thereof to other persons or circumstances, and the
Board of Trustees of the Incorporated Village of Huntington
Bay hereby declares that it would have passed this
Local Law or the remainder thereof had such invalid
application or invalid provision been apparent.
Effective Date.
This Local Law shall take effect immediately
upon filing in the Office of the Secretary of State
of New York.
